FOCUS ON REDUCTION AND SIMPLIFICATION OF ADMINISTRATIVE PROCEDURES IN CONSTRUCTION SECTOR

In recent years, the Government and the Prime Minister have issued a lot of Resolutions and documents [1] to drastically, promptly and efficiently direct the reform of administrative procedures; the Ministry of Construction has cooperated with ministries, central and local authorities to promote review, reduction and simplification of administrative procedures in the construction sector and achieve some outstanding results, including: (i) enhancement of delegation of powers from central authorities to local authorities over appraisal of projects, design and issuance of construction permits; (ii) reduction in the number of construction projects having to undergo procedures for appraisal of construction investment feasibility study reports, formulation of projects on investment and design in construction; (iii) reduction in quantity of eligibility certificates, and simplification of construction practice certificates [2]; (iv) reduction and simplification of administrative procedures related to investment in construction [3]. However, people and enterprises complain that the duration of implementation of some construction investment projects is still prolonged, projects must undergo a lot of administrative procedures and administrative costs are still high.
In order to strongly, practically and drastically reform administrative procedures in the construction sector, meet the requirements and follow directions of the Politburo, the Secretariat[4], and the Government[5], the Prime Minister requests the Minister of Construction and Chairpersons of People's Committees of provinces and central-affiliated cities to continue to perform the tasks and adopt solutions assigned in the Government’s Resolution No. 66/NQ-CP dated March 26, 2025, Official Telegram No. 69/CD-TTg dated May 22, 2025 of the Prime Minister and focus on a number of specific tasks. To be specific:
1. The Minister of Construction shall focus on:
a) urgently reviewing, reducing, and simplifying 361 administrative procedures related to production and business, and 447 business conditions under the management of the Ministry of Construction in order to make sure that at least 30% of the duration of processing administrative procedures, 30% of the administrative cost, and 30% of business conditions in 2025 are reduced, with a focus on study, review, strong reduction and simplification of administrative procedures in the construction sector.
b) reducing and simplifying procedures for issuance of construction permits to constructions under a construction investment project for which a detailed planning at the scale of 1/500 is tailored or constructions in areas for which urban designs have been approved.
c) reducing the number of construction projects having to undergo procedures for appraisal of projects and designs at construction authorities.
d) reviewing and fully and additionally issuing necessary technical standards and regulations in the construction sector, especially those on construction planning in order to facilitate construction investment activities; annulling and amending technical standards and regulations that are no longer appropriate and cause waste during investment in constructions.
dd) reducing and simplifying administrative procedures related to construction capacity of enterprises by switching over from issuance of certificates of eligibility for construction business to self-declaration of eligibility by enterprises with ex post inspection by competent authorities; reducing conditions for business investment in the construction sector.
e) continuing to conduct study to thoroughly delegate powers to process administrative procedures for appraisal of projects, design, issuance of construction permits, and inspection of acceptance, in conformity with arrangement of administrative divisions and implementation of the 2-level local government organization model.
g) promoting digitalization, automation (BIM, GIS, IoT,etc.), reuse of data (planning, land, construction, population, enterprises, etc.) during the implementation of administrative procedures in the construction sector so as to reduce the number of records and documents, procedures and the duration of processing administrative procedures.
h) taking responsibility to the Government and the Prime Minister for results of reduction and simplification of administrative procedures, business conditions, reduction in administrative costs, and the duration of processing administrative procedures under the management of the Ministry of Construction according to objectives, requirements, and directions in Resolutions of the Politburo, the Government, and the tasks in this Official Telegram; reporting to the Prime Minister on implementation results (included in administrative procedure reform reports) before the 25th of each month.
2. People's Committees of provinces and central-affiliated cities shall focus on:
a) organizing implementation of administrative procedures within their jurisdiction in order to stably, continuously, efficiently and uninterruptedly delegate powers, arrange administrative divisions, and implement the 2-level local government organization model.
b) proactively conducting study and organizing the implementation of interconnected administrative procedures related to construction investment activities within their jurisdiction, thereby achieving efficiency, reducing procedures, duration, and costs of implementation of administrative procedures for people and enterprises.
c) proactively monitoring and inspecting within their jurisdiction compliance with the law on investment in construction by entities participating in construction investment activities to perform state management and maintain social order and safety upon transition from pre-inspection to ex post inspection and delegation of powers to process administrative procedures.
3. The Government Office monitors and urges the performance of the above tasks within its assigned functions and tasks; and promptly sends consolidated reports to the Prime Minister on issues beyond its jurisdiction./.

[3] Example: the Law on Fire Prevention and Firefighting (amended) and the Decree No. 105/2025/ND-CP only have 3 groups with 06 administrative procedures for fire prevention and firefighting (previously 10 groups with 37 administrative procedures).
