DECREE
DEFINING THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE GOVERNMENT INSPECTORATE OF VIETNAM
Pursuant to the Law on Government Organization dated February 18, 2025;
At the request of the Inspector-General;
The Government hereby promulgates a Decree defining the functions, tasks, powers and organizational structure of the Government Inspectorate.
Article 1. Position and functions
The Government Inspectorate of Vietnam is a ministerial agency of the Government and exercises the functions of performing state management of inspection, citizen reception, settlement of complaints and denunciations, and prevention of and combat against corruption and negativity nationwide; shall carry out inspection, receive citizens, settle complaints and denunciations, and prevent and combat corruption and negativity as per law.
Article 2. Tasks and powers
The Government Inspectorate of Vietnam shall perform the tasks specified and exercise the powers as specified in the Law on Government Organization, Law on Inspection, Law on Citizen Reception, Law on Complaints, Law on Denunciation, Anti-corruption Law and Government’s regulations on functions, tasks, powers and organizational structures of ministries and ministerial agencies, and has the following specific tasks and powers:
1. Submit to the Government bills and draft resolutions of the National Assembly, ordinance projects and draft resolutions of the Standing Committee of the National Assembly, draft resolutions and decrees of the Government, and draft decisions of the Prime Minister on inspection, citizen reception, settlement of complaints and denunciations, and prevention of and combat against corruption and negativity under its approved annual law-making programs and plans, and other projects and drafts of legislative documents as assigned by the Government and Prime Minister.
2. Submit to the Government and Prime Minister for approval strategies, planning, and annual, medium- and long-term development plans on the fields under its state management; draft decisions and directives and other documents on inspection, citizen reception, settlement of complaints and denunciations, and prevention of and combat against corruption and negativity, and organize the implementation thereof.
3. Promulgate circulars, decisions, directives and other documents on inspection, citizen reception, settlement of complaints and denunciations, and prevention of and combat against corruption and negativity under its authority.
4. Direct, provide guidance on, examine and organize the implementation of legislative documents and approved strategies, programs and plans for inspection, citizen reception, settlement of complaints and denunciations, and prevention of and combat against corruption and negativity; disseminate information about, propagate, popularize and provide education about laws on inspection, citizen reception, settlement of complaints and denunciations, and prevention of and combat against corruption and negativity.
5. Regarding inspection:
a) Develop inspection program orientations and submit them to the Prime Minister for approval; formulate and organize the implementation of its inspection plans; instruct the Inspectorate of the Ministry of National Defense, Inspectorate of the Ministry of Public Security, Inspectorate of the State Bank of Vietnam, Cipher Inspectorate, inspection agencies under treaties, Inspectorates of central-affiliated cities and provinces (hereinafter referred to as “Provincial Inspectorates”) to formulate their inspection plans, expedite and examine the implementation of inspection plans;
b) Inspect the implementation of policies and laws, performance of tasks and exercise of powers by ministries, ministerial agencies, Governmental agencies and People’s Committees of provinces and central-affiliated cities (hereinafter referred to as “provincial People’s Committees”); inspect the implementation of policies and laws, performance of tasks and exercise of powers by agencies, organizations, units and individuals under management of ministries without a Ministry Inspectorate;
c) Inspect the compliance with laws in the fields under the state management of ministries without a Ministry Inspectorate
d) Inspect complicated cases involving state management responsibilities of multiple ministries, ministerial agencies and provincial People’s Committees;
dd) Inspect the management and use of state capital and assets in enterprises;
e) Carry out inspection when detecting any signs of violation against laws;
g) Inspect cases at the request of Ministers, heads of ministerial agencies and heads of Governmental agencies;
h) Inspect other cases as assigned by the Prime Minister and competent authorities;
i) Verify the accuracy and legitimacy of inspection conclusions of the Inspectorate of the Ministry of National Defense, Inspectorate of the Ministry of Public Security, Inspectorate of the State Bank of Vietnam, Cipher Inspectorate, inspection agencies established in accordance with treaties, provincial inspectorates and post-inspection handling decisions of heads of state management agencies when necessary;
k) Re-inspect cases on which conclusions have been drawn by the Inspectorate of the Ministry of National Defense, Inspectorate of the Ministry of Public Security, Inspectorate of the State Bank of Vietnam, Cipher Inspectorate, inspection agencies under treaties, provincial inspectorates when any sign of violation against laws is detected;
l) Supervise, expedite and inspect the implementation of its inspection conclusions, inspection-related handling decisions of the Prime Minister;
m) Request ministries, ministerial agencies, Governmental agencies, provincial People’s Committees to appoint persons having professional expertise to join its inspection delegations when necessary;
n) Cooperate with the State Audit Office of Vietnam in handling overlaps and duplications between inspection and state audit activities; instruct inspection agencies in handling overlaps between inspection and state audit activities; preside over and provide guidance on handling of overlaps and duplications in inspection activities among inspection agencies in accordance with law;
o) Recommend competent state agencies to amend and supplement existing regulations or promulgate new ones to meet management requirements; recommend suspension, cancellation or annulment of unlawful regulations detected through inspection;
p) Propose the Prime Minister, competent agencies and organizations and request heads of agencies and organizations to examine the responsibility of, and impose penalties upon, persons under their management who commit acts of violating laws detected through inspection or fail to implement inspection-related conclusions, recommendations and handling decisions.
6. Regarding citizen reception and settlement of complaints and denunciations:
a) Receive citizens; receive and process complaints, denunciations, petitions and feedback; settle complaints and denunciations in accordance with law;
b) Preside over and cooperate with related agencies in receiving citizens at central-level citizen reception offices;
c) Supervise, examine and expedite citizen reception, settlement of complaints and implementation of decisions on complaint settlement by ministries, Governmental agencies and provincial People’s Committees;
d) Propose the Prime Minister or competent persons to apply necessary measures to terminate violations, examine the responsibility of and impose penalties upon violators when detecting that the settlement of complaints causes damage to the State’s interests or legitimate rights and interests of citizens, agencies and organizations;
dd) Receive, classify and propose the settlement of denunciations under the authority of the Prime Minister when so assigned;
e) Verify contents of denunciations, report verification results and recommend measures to settle denunciations under the settlement authority of the Prime Minister when so assigned;
g) Consider the settlement of denunciations by Ministers, heads of ministerial agencies, heads of Governmental agencies and chairpersons of provincial People’s Committees which is suspected of violating laws; in case there are grounds for presuming that the settlement violates law, propose it to the Prime Minister for consideration and re-settlement;
h) Build, manage and exploit the national database on citizen reception, processing of letters of complaints and denunciations, and settlement of complaints, denunciations and feedback.
7. Regarding prevention of and combat against corruption and negativity:
a) Organize, direct and provide guidance on the implementation of regulations of law on prevention of and combat against corruption and negativity under its authority or as directed by the Government, Prime Minister and competent authorities;
b) Inspect cases and matters showing signs of corruption, waste and negative accts under its authority; inspect the implementation of the law on prevention of and combat against corruption and negativity by ministries, Governmental agencies, provincial People’s Committees, non-state enterprises and organizations under its authority or as directed by the Prime Minister and competent authorities or at the request of Ministers, heads of ministerial agencies, heads of Governmental agencies and chairpersons of provincial People’s Committees;
c) Cooperate with agencies and organizations in detecting corruption, waste and negativity; expedite the imposition of penalties upon persons who commit corruption, waste and negativity in accordance with law;
d) Control assets and income of persons who hold positions and powers in agencies, organizations and units under its authority; build, manage, exploit and protect the national database on control of assets and income;
dd) Monitor and assess the situation of corruption and negativity and the prevention of and combat against corruption and negativity in ministries, central and local authorities, and non-state sectors;
e) Cooperate with the State Audit Office of Vietnam, Ministry of Public Security, Ministry of National Defense, People’s Supreme Procuracy, Supreme People’s Court, Central Internal Political Commission and agencies within the internal political bloc in providing and exchanging information, documents and experience related to the prevention of and combat against corruption, waste and negativity; review, assess and forecast the situation of corruption and negativity, and propose policies and solutions against corruption and negativity.
8. Provide guidance on and implement regulations on power control, prevention of and combat against corruption and negativity in inspection, citizen reception, settlement of complaints and denunciations, and prevention of and combat against corruption and negativity in accordance with regulations of the Communist Party and laws of the State.
9. Request ministries, ministerial agencies, Governmental agencies and provincial People’s Committees to report the situation and results of and experiences in citizen reception, settlement of complaints and denunciations, prevention of and combat against corruption and negativity and inspection with regard to the Ministry of National Defense, Ministry of Public Security, State Bank of Vietnam and provincial People’s Committee for consolidation and reporting to the Government.
10. Perform the function of the standing agency to implement the United Nations Convention against Corruption, and act as a national focal point to support the international provision of information about the prevention of and combat against corruption; seek international cooperation in inspection, citizen reception, settlement of complaints and denunciations and prevention of and combat against corruption and negativity.
11. Organize and direct the implementation of programs and plans for scientific research and application of scientific and technological advances to inspection, citizen reception, settlement of complaints and denunciations and prevention of and combat against corruption and negativity.
12. Carry out administrative reform under the state administrative reform programs and plans of the Government and directions of the Prime Minister.
13. Apply information technology and digital transformation, and manage specialized data serving its state management function.
14. Manage, appoint, dismiss, and issue inspector cards to inspectors of different ranks in accordance with law.
15. Manage the organizational apparatus, payrolls, cadres, public officials, public employees and employees; implement the salary regime and preferential treatment, commendation and discipline regimes and policies for cadres, public officials, public employees and employees under its management in accordance with law.
16. Offer written opinions on the appointment, re-appointment and dismissal of Chief Inspector of Ministry of National Defence, Chief Inspector of Public Security, Chief Inspector of State Bank of Vietnam, Chief Cipher Inspector and provincial inspectorates.
17. Provide professional further training for its cadres, public officials and public employees; provide professional further training in and guidance on inspection, citizen reception, settlement of complaints and denunciations, prevention of and combat against corruption and negativity for cadres and public officials of ministries, central and local authorities.
18. Manage allocated finances and assets, and organize allocation and implementation of state budget estimates according to regulations of law.
19. Manage and direct the operation of its affiliated public service providers in accordance with law.
20. Perform other tasks as assigned by the Government and Prime Minister and as prescribed by law.
Article 3. Organizational structure

6. Bureau for Settlement of Complaints-Denunciations and Inspection for the North region (Bureau I).
7. Bureau for Settlement of Complaints-Denunciations and Inspection for the Central region (Bureau II).
8. Bureau for Settlement of Complaints-Denunciations and Inspection for the Southern region (Bureau III).
9. Anti-corruption Bureau (Bureau IV).
10. Department for Inspection and Settlement of Complaints-Denunciations in areas of internal affairs, home affairs, ethnicity and religion (Department V).
11. Department for Inspection and Settlement of Complaints-Denunciations in areas of finance and banking (Department VI).
12. Department for Inspection and Settlement of Complaints-Denunciations in area of construction (Department VII).
13. Department for Inspection and Settlement of Complaints-Denunciations in areas of agriculture and environment (Department VIII).
14. Department for Inspection and Settlement of Complaints-Denunciations in areas of industry and trade (Department IX).
15. Department for Inspection and Settlement of Complaints-Denunciations in areas of health and education (Department X).
16. Department for Inspection and Settlement of Complaints-Denunciations in areas of culture, sports, tourism and foreign affairs (Department XI).
17. Department for Inspection and Settlement of Complaints-Denunciations in areas of science and technology (Department XII).
18. Department for Supervision and Verification (Department XIII).
19. Department for Post-inspection Monitoring, Expedition and Settlement (Department XIV).
20. Central Citizen Reception Committee.
21. Inspection Newspaper.
22. Inspector Training College.
The units specified in clauses 1 through 20 of this Article are administrative organizations that assist the Inspector-General in performing the state management function; the units specified in clauses 21 through 22 are public service providers that serve the state management function of the Government Inspectorate of Vietnam.
The Central Citizen Reception Committee directly manages the Central Citizen Reception Offices in Hanoi and Ho Chi Minh City.
The Inspector-General shall define functions, tasks, powers and organizational structures of units attached to the Government Inspectorate of Vietnam.
Article 4. Repealing and amending regulations on inspection specified under relevant Decrees
1. The phrase “Thanh tra,” (“Inspect,”) in clause 30 Article 2 is repealed; clause 11 Article 3 of the Government’s Decree No. 25/2025/ND-CP dated February 21, 2025 defining functions, tasks, powers and organizational structure of the Ministry of Home Affairs is repealed.
2. The phrase “Thanh tra,” (“Inspect,”) in clause 26 Article 2 is changed to “Kiểm tra” (“Examine”); clause 14 Article 3 of the Government’s Decree No. 28/2025/ND-CP dated February 24, 2025 defining functions, tasks, powers and organizational structure of the Ministry of Foreign Affairs is repealed.
3. The phrase “, thanh tra” (“, inspect”) in point g clause 7, points b, c and d clause 14 Article 2 is repealed; the phrase “Thanh tra” (“Inspect”) in point d clause 22 Article 2 is changed to “Kiểm tra” (“Examine”); the phrase “Thanh tra” (“Inspect”) in clause 28 Article 2 is repealed; clause 11 Article 3 of the Government’s Decree No. 29/2025/ND-CP dated February 24, 2025 defining functions, tasks, powers and organizational structure of the Ministry of Finance is repealed.
4. The phrase “Thanh tra,” (“Inspect,”) in clause 29 Article 2 is repealed; clause 2 Article 3 of the Government’s Decree No. 33/2025/ND-CP dated February 25, 2025 defining functions, tasks, powers and organizational structure of the Ministry of Construction is repealed.
5. The phrase “, thanh tra,” (“, inspect”) in clause 44 Article 2 is repealed; clause 7 Article 3 of the Government’s Decree No. 35/2025/ND-CP dated February 25, 2025 defining functions, tasks, powers and organizational structure of the Ministry of Agriculture and Environment is repealed.
6. The phrase “, thanh tra,” (“, inspect”) in clause1 Article 2 is repealed; clause 10 Article 3 of the Government’s Decree No. 37/2025/ND-CP dated February 26, 2025 defining functions, tasks, powers and organizational structure of the Ministry of Education and Training is repealed.
7. The phrase “thanh tra,” (“inspect,”) in clause 17 Article 2 is repealed; clause 7 Article 3 of the Government’s Decree No. 39/2025/ND-CP dated February 26, 2025 defining functions, tasks, powers and organizational structure of the Ministry of Justice is repealed.
8. The phrase “Thanh tra,” (“Inspect,”) in clause 38 Article 2 is repealed, the phrase “thanh tra chuyên ngành” (“specialized inspection”) in clause 38 Article 2 is changed to “kiểm tra chuyên ngành” (“specialized examination”); clause 7 Article 3 of the Government’s Decree No. 40/2025/ND-CP dated February 26, 2025 defining functions, tasks, powers and organizational structure of the Ministry of Industry and Trade is repealed.
9. The phrase “Thanh tra,” (“Inspect,”) in clause 16 Article 2 is repealed; clause 5 and phrase “, Thanh tra bộ” (“, Ministry Inspectorate”) in Article 3 of the Government’s Decree No. 25/2025/ND-CP dated February 21, 2025 defining functions, tasks, powers and organizational structure of the Ministry of Ethnic and Religious Affairs is repealed.
10. The phrases “Thanh tra,” (“Inspect,”), “; thực hiện nhiệm vụ thanh tra hành chính đối với cơ quan, tổ chức, cá nhân thuộc quyền quản lý của Bộ Y tế; thực hiện nhiệm vụ thanh tra chuyên ngành trong các lĩnh vực thuộc phạm vi quản lý nhà nước của Bộ Y tế” (“; carry out administrative inspection of regulatory authorities, organizations and individuals under its management; carry out specialized inspection in the fields within the scope of its management”) in clause 29 Article 2 are repealed; clause 7 Article 3 of the Government’s Decree No. 42/2025/ND-CP dated February 271, 2025 defining functions, tasks, powers and organizational structure of the Ministry of Health is repealed.
11. The phrase “Thanh tra,” (“Inspect,”) in clause 39 Article 2 is repealed, the phrase “thanh tra chuyên ngành” (“specialized inspection”) in clause 39 Article 2 is changed to “kiểm tra chuyên ngành” (“specialized examination”); clause 6 Article 3 of the Government’s Decree No. 43/2025/ND-CP dated February 28, 2025 defining functions, tasks, powers and organizational structure of the Ministry of Culture, Sports and Tourism is repealed.
12. The phrase “thanh tra,” (“inspect,”) in clause 27 Article 2 is repealed; clause 11 Article 3 of the Government’s Decree No. 55/2025/ND-CP dated March 02, 2025 defining functions, tasks, powers and organizational structure of the Ministry of Science and Technology is repealed.
13. The phrase “, thanh tra” (“, inspect”) in clause 10 is repealed, the phrase “, thanh tra (nếu có)” (“, inspectorate (if any)”) in clause 11 Article 4 is repealed; point b clause 1 Article 5, clause 3 Article 6, clause 8 Article 15; the phrase “, thanh tra” (“, inspect”) in clause 4 Article 18, clause 4 Article 19, clause 4 Article 21 and clause 3 Article 23 of the Government’s Decree No. 45/2025/ND-CP dated February 28, 2025 providing for organization of specialized agencies affiliated to People’s Committees of provinces and central-affiliated cities and People’s Committees of rural districts, urban districts, district-level towns, provincial-affiliated cities and cities affiliated to central-affiliated cities is repealed.
Article 5. Effect
1. This Decree comes into force from June 01, 2025.
2. This Decree replaces the Government’s Decree No. 81/2023/ND-CP dated November 27, 2023 defining the functions, tasks, powers and organizational structure of the Government Inspectorate of Vietnam.
Article 6. Responsibility for implementation
Ministers, heads of ministerial agencies, heads of Governmental agencies, chairpersons of People’s Committees of provinces and central-affiliated cities are responsible for the implementation of this Decree.
