CIRCULAR
PROVIDING FOR MANAGEMENT AND MAINTENANCE OF NATIONAL RAILWAY INFRASTRUCTURE
Pursuant to the Law on Construction 2014 dated October 18, 2014; Law on Amendments to some Articles of the Law on Construction 2020 dated June 17, 2020;
Pursuant to the Law on Railway Transport dated June 16, 2017;
Pursuant to the Government’s Decree No. 56/2018/ND-CP dated April 16, 2018 providing for management and protection of railway infrastructure;
Pursuant to the Government’s Decree No. 32/2019/ND-CP dated April 10, 2019 on assignment, order placement or bidding for product and public service provision using state budget from recurrent expenditure;
Pursuant to the Government’s Decree No. 06/2021/ND-CP dated January 26, 2021 elaborating on the implementation of several regulations on quality management, construction and maintenance of construction works;
Pursuant to the Government’s Decree No. 35/2023/ND-CP dated June 20, 2023 on amendments to some Articles of Decrees in the field of state management of the Ministry of Construction;
Pursuant to the Government’s Decree No. 85/2024/ND-CP dated July 10, 2024 elaborating some Articles of the Law on Prices;
Pursuant to the Government’s Decree No. 175/2024/ND-CP dated December 30, 2024 elaborating and providing measures for implementation of the Law on Construction regarding management of construction activities;
Pursuant to the Government’s Decree No. 15/2025/ND-CP dated February 03, 2025 ON management, use and operation of railway infrastructure assets;
Pursuant to the Government’s Decree No. 33/2025/ND-CP dated February 25, 2025 defining the functions, tasks, powers and organizational structure of the Ministry of Construction;
At the request of the Director General of the Transport Infrastructure Department and the Director General of the Vietnam Railway Authority;
The Minister of Transport hereby promulgates a Circular providing for management and maintenance of national railway infrastructure.
Chapter I
GENERAL PROVISIONS
Article 1. Scope and regulated entities
1. This Circular provides for management and maintenance of national railway infrastructure.
2. This Circular applies to organizations and individuals related to management of railway infrastructure and maintenance of national railway works in which the State invests.
Article 2. Definitions
For the purposes of this Circular, the terms below shall be construed as follows:
1. “maintenance of a railway work” means a collection of activities aimed at ensuring and maintaining the applicability and safety of the work in accordance with the design requirements or maintenance procedures.
2. “servicing of a railway work” means the supervision, caring and repair of minor defects of the work or equipment installed in the work, patrolling or watchstanding for handling of barriers to train operation which are carried out in a regular or periodic manner to maintain the normal operation and usage status of the work and restrict any possible defect of the work.
3. “repair of a railway work” means the correction, restoration, improvement or replacement of any defect of a part, equipment or structural component of the work or the entire work that is discovered during its operation and use in order to ensure applicability and safety of the work and rail transport safety. The railway work repairs include periodic and unscheduled repairs:
a) Periodic repair of a railway work means the repair of any defect or improvement or replacement of a damaged part or equipment installed in this work which is carried out in a periodic manner in accordance with the railway work maintenance procedures or railway work management and maintenance plan which has been already approved;
b) Unscheduled repair of a railway work means the repair of part or whole of the work that is damaged due to unexpected effects such as wind, storm, flood, earthquake, collision, fire and others, or of part or whole of the work that shows any sign of degradation to the extent of adverse effect on safe use, operation and exploitation of the work.
4. “inspection of a railway work” means the observation being conducted visually or using specialized equipment to assess the current condition of the work in order to promptly detect signs of deterioration or damage to the work or equipment installed therein, thereby taking timely corrective actions. The railway work inspections include regular, periodic and unscheduled inspections.
5. “other tasks” mean those determined under the railway work management and maintenance plan, including work inspection; formulation and verification of railway work maintenance procedures; formulation and verification of techno-economic norms for maintenance of railway works; supervision and preservation of materials recovered from railway work maintenance; dismantling and handling of railway infrastructure assets; formulation and updating of dossiers on railway infrastructure management and maintenance; planting of boundary markers for land area for rail transport; several tasks arising during the operation and exploitation of railway infrastructure.
6. “railway maintenance database” means a collection of information about railway works and railway work maintenance history updated and exploited on the railway infrastructure management information system.
7. “national railway infrastructure asset managing enterprise” means an enterprise 100% of charter capital of which is held by the State and to which national railway infrastructure assets are assigned to manage the national railroad infrastructure assets that are not recorded as state capital in enterprises.
Chapter II
MANAGEMENT OF RAILWAY INFRASTRUCTURE AND MAINTENANCE OF RAILWAY WORKS
Article 3. Contents of management of railway infrastructure
1. Formulating and approving railway work management and maintenance plans, setting and approving prices for public services for railway work management and maintenance; managing financial resources for management of infrastructure and maintenance of railway works.
2. Implementing railway work management and maintenance plans and managing quality of public services for management and maintenance of railway infrastructure.
3. Preventing, combating and recovering from consequences of incidents and natural disasters affecting railway infrastructure.
4. Protecting railway infrastructure as prescribed.
5. Managing, supervising and organizing handling of important works that pose a risk of danger to safety during their use.
6. Organizing the preparation of railway work maintenance dossiers and updating of railway work maintenance database.
7. Submitting periodic and unscheduled reports as prescribed.
Article 4. Contents of maintenance of railway works
1. Contents of railway work maintenance shall be made into a railway work management and maintenance plan, including the following tasks: servicing, monitoring and other tasks; management and supervision of railway work maintenance; repair of works; addition and replacement of items and equipment of works to ensure safe exploitation and use of works.
2. The construction repair task shall be determined according to construction design or technical plan and implemented according to regulations of law on quality management, construction and maintenance of construction works.
3. Tasks of railway work servicing and management and supervision of railway work servicing tasks; addition and replacement of items and equipment of works shall be determined according to the technical operation plan of the national railway asset managing enterprise.
4. Monitoring tasks and other tasks shall be determined according to the approved outline and implemented in accordance with regulations of law on quality management, construction and maintenance of construction works.
Article 5. Requirements for management of railway infrastructure and maintenance of railway works
1. Management of railway infrastructure shall be uniformly performed in a manner that clearly decentralizes power and responsibility to each authority and organization and responsibility for cooperation between authorities and units.
2. Railway work maintenance shall be carried out according to the approved railway work management and maintenance plan, and maintenance procedures.
3. The maintenance of railway works must ensure safety of persons, property and works; ensure safe and continuous traffic; fire and explosion prevention and fighting, and environmental protection.
4. Tasks performed prior to their revisions under the railway work management and maintenance plan consist of:
a) Works for step 1 recovery from damage caused by incidents and natural disasters according to regulations of law on natural disaster management; incident response and rescue in the railway sector;
b) Task of handling of railway works that pose a risk of danger to safety during their exploitation and use as prescribed in Article 8 of this Circular.
Article 6. Dossiers on management of railway infrastructure and maintenance of railway works
1. Dossiers on management of railway infrastructure shall be prepared for each type of railway work in a manner that is appropriate to the scope of management and shall be regularly updated to serve the maintenance of railway works. Dossiers on management of railway infrastructure include dossier on engineering of works; dossier on management of work protection perimeters and railway safety corridors; dossier on completion of works (if any) and are regulated as follows:
a) Dossier on technical status of a work:
A technical status dossier shall be prepared for each work, showing the location, perimeter, scale; technical specifications; construction and repair time; inspection time and current technical status of the work;
The technical status dossier includes the documents specified under the maintenance procedures and a table showing technical status of the work as specified in the Appendix I to this Circular;
b) A dossier on management of railway work protection perimeter and railway safety corridor shall be prepared for each railway line in administrative divisions within each province or city, ensuring its consistency with dossier on boundary markers for land area for rail transport according to Government’s regulations on management and protection of railway infrastructure. The dossier is mainly composed of railway work construction perimeter, railway work protection perimeter and railway safety corridor;
c) Dossiers on completion of works shall comply with the Government’s regulations on quality management, construction and maintenance of construction works;
d) The dossier on technical status of a work and dossier on management of work protection perimeters and railway safety corridor shall be updated within 90 days from the date on which the work maintenance is completed or any change is made in reality.
2. Railway work maintenance dossiers
a) A railway work maintenance dossier shall include the documents serving the maintenance and the dossier on completed maintenance shall be prepared for each work or task according to the approved railway work management and maintenance plan;
b) Documents serving the railway work maintenance shall comprise results of investigation of basic status of railway works; railway work management and maintenance plan and public service price plan approved; results of inspection, monitoring, and assessment of quality of works (if any) in service of maintenance;
c) A dossier on completed servicing of a work shall include the approved technical operation plan; documents about management of quality of work servicing according to maintenance procedures and records on acceptance of maintenance task;
d) A dossier on completed repair of a work be prepared according to the Government’s regulations on quality management, construction and maintenance of construction works;
dd) Dossiers on completion of works for recovery from incidents and natural disasters with regard to railway works shall be prepared according to regulations of the Minister of Construction on natural disaster management; incident response and rescue in the railway sector;
e) Other dossiers and documents relating to maintenance of railway works.
Article 7. Assessment of safety of railway works during their exploitation and use
1. Railway works that greatly affect safety and benefits of the community as per the Government’s regulations on management of construction investment projects must have their safe bearing capacity and operational safety assessed during periodic or unscheduled exploitation and use.
2. Procedures for conducting work safety assessment and contents of railway work safety assessment shall comply with regulations of law on quality management, construction and maintenance of construction works.
3. The national railway asset managing enterprise shall conduct review and compile a list of railway works subject to work safety assessment according to regulations of law on quality management, construction and maintenance of construction works; the Vietnam Railway Authority shall conduct review and publish the list of works as a basis for implementation according to regulations.
Article 8. Handling of railway works that pose a risk of danger to safety during their exploitation and use
1. In the course of carrying out railway maintenance, the national railway asset managing enterprise must promptly detect damaged or quality degraded railway works, parts of works and equipment installed in railway works, thereby failing to ensure safety upon their exploitation and use in order to handle them according to regulations.
2. Upon discovering or receiving information about a work or part of a work or equipment installed in a railway work that are damaged or degraded in terms of quality, and unsafe for exploitation and use, the national railway asset managing enterprise shall:
a) Decide emergency measures and organize handling to ensure train operation safety;
b) Submit to the Vietnam Railway Authority a report on handling result or recommend the inspection of work quality (if necessary), monitoring and unscheduled repair of the work. The report shall be prepared using the form in the Appendix II to this Circular.
3. Upon receiving the report from the national railway asset managing enterprise, the Vietnam Railway Authority shall decide to carry out work quality inspection, monitoring and unscheduled repair of the work and report the result thereof to the Ministry of Construction.
4. After the Vietnam Railway Authority decides to so implement as specified in clause 3 of this Article, the national railway asset managing enterprise shall comply with the following regulations:
a) The inspection of work quality and work monitoring shall comply with regulations of law on quality management, construction and maintenance of construction works;
b) Conduct unscheduled repair of the work as prescribed in clause 3 Article 12 of this Circular.
5. The results of quality inspection, monitoring and unscheduled repair shall be updated and added to the railway work management and maintenance plan or adjusted plan.
Article 9. Monitoring and inspection of quality of railway works and their parts during their exploitation and use
1. Monitoring of works and inspection of quality of works during their exploitation and use shall be carried out in the cases as per Government’s regulations on quality management, construction and maintenance of construction works.
2. The national railway asset managing enterprise shall conduct review, compile a list of railway works subject to monitoring and quality inspection assessment and send it to the Vietnam Railway Authority to form a basis for formulation of an annual railway work management and maintenance plan.
3. The national railway asset managing enterprise shall monitor and inspect quality of railway works in accordance with Government’s regulations on quality management, construction and maintenance of construction works.
Article 10. Application of standards and techno-economic norms to maintenance of railway works
1. Standards, techno-economic norms and cost norms issued by competent authorities shall apply to the maintenance of railway works.
2. For the tasks for which standards, techno-economic norms, or cost norms issued by competent authorities are not available, they shall be determined at the construction unit price announced by the provincial People's Committee or determined based on market prices or similar prices applicable completed works.
Chapter III
ORGANIZING MANAGEMENT OF RAILWAY INFRASTRUCTURE AND MAINTENANCE OF RAILWAY WORKS
Article 11. Formulation, approval and modification of railway work management and maintenance plans
1. Formulation of a railway work management and maintenance plan
a) According to technical conditions of railway works, transportation demands of each railway line currently in operation, maintenance procedures, techno-economic norms, related technical regulations and standards, every national railway infrastructure asset managing enterprise shall formulate a railway work management and maintenance plan on an annual basis or over the plan period within the assigned scope in order to ensure safety of works during their operation;
b) The railway work management and maintenance plan shall sufficiently include the following information: name of each railway work and work item; unit, quantities and estimated budget for implementation of that plan; implementation time; implementation approaches and priority degree with regard to works subject to periodic repair.
c) Contents of the railway work management and maintenance plan include:
Railway work servicing;
Work repair;
Performed task of recovery from incidents or natural disasters;
Inspection, monitoring and other tasks (if any);
Management and supervision of railway work servicing;
Tasks of emergency handling of work incidents; recovery from incidents and natural disasters for the following year;
Management and protection of railway infrastructure;
d) Composition of a dossier on railway work management and maintenance plan submitted for approval:
An explanatory note to the railway work management and maintenance plan, which states conditions of railway works, transportation demands of each railway line currently in operation, maintenance procedures, techno-economic norms, applicable technical regulations and standards and plan for budget allocation;
The railway work management and maintenance plan shall be prepared using the form in the Appendix III to this Circular;
The bill of quantities for railway work servicing shall be made using the form in the Appendix IV to this Circular;
Technical status dossier prescribed in point a clause 1 Article 6 of this Circular. In case adequate information about status of railway works is available in the railway work maintenance database, the national railway asset managing enterprise shall confirm this in the written request as a substitute for physical documents;
dd) The national railway asset managing enterprise shall organize the formulation of the annual railway work management and maintenance plan and submit it to the Ministry of Construction and the Vietnam Railway Authority before every June 01 for appraisal; the Vietnam Railway Authority shall complete the appraisal report before every June 20. According to the appraisal report of the Vietnam Railway Authority, the national railway infrastructure asset managing enterprise shall receive appraisal opinions, complete the maintenance demand plan and submit it to the Ministry of Construction for consideration and approval.
2. According to the approved management and maintenance demand plan, the Ministry of Construction shall include the estimated costs of railway work management and maintenance in the annual state budget collection and expenditure estimate of the Ministry of Construction for submission to the Ministry of Finance before every July 20.
3. Approval of the railway work management and maintenance plan
a) On the basis of the Ministry of Construction’s notification of the estimate of state budget expenditures on railroad business activities, the national railway asset managing enterprise shall conduct review and update the railway work management and maintenance plan of the planning year in a manner that is appropriate to the allocated budget and submit it to the Ministry of Construction and the Vietnam Railway Authority for appraisal. The composition of dossier on and contents of the railway work management and maintenance plan are specified under points b, c and d clause 1 of this Article; the railway work management and maintenance plan submission shall be prepared using the form in the Appendix V hereto;
b) The Vietnam Railway Authority shall carry out appraisal and send the appraisal result to the Ministry of Construction and the national railway infrastructure asset managing enterprise before every December 15;
c) According to the appraisal report of the Vietnam Railway Authority, the national railway infrastructure asset managing enterprise shall receive appraisal opinions, complete the railway work management and maintenance plan and submit it to the Ministry of Construction for approval before every December 25.
4. Adjustment of a railway work management and maintenance plan:
a) The railway work management and maintenance plan shall be adjusted during its implementation to make it compatible with actual technical conditions of railway works;
b) The national railway asset managing shall prepare a dossier on adjustment of the plan and submit it to the Ministry of Construction and the Vietnam Railway Authority for appraisal before every October 01. The Vietnam Railway Authority shall complete the appraisal report before every October 10;
c) The composition of dossier on and contents of the railway work management and maintenance plan are specified under points b, c and d clause 1 of this Article;
d) According to the appraisal report of the Vietnam Railway Authority, the national railway infrastructure asset managing enterprise shall receive appraisal opinions, complete the railway work management and maintenance plan and submit it to the Ministry of Construction for approval before every October 31.
Article 12. Implementation of the railway work management and maintenance plan
1. Based on the railway work management and maintenance plan and state budget expenditure estimate assigned by the Ministry of Construction, the national railway asset managing enterprise shall organize maintenance of railway works.
2. Railway work servicing
a) The national railway asset managing enterprise shall place orders for supply of public products and services as per the Government’s regulations on management, use and exploitation of national railway infrastructure assets;
b) Upon servicing of railway works in the form of order placement, the formulation, appraisal and promulgation of a document on pricing public services shall be carried out as follows:
The national railway asset managing enterprise shall organize the formulation of a public service pricing plan and submit it to the Ministry of Construction and the Vietnam Railway Authority before every January 15;
The Vietnam Railway Authority shall appraise the public service pricing plan and send a consolidated report thereon to the Ministry of Construction before every February 05. Based on the appraisal opinions of the Vietnam Railway Authority, the Ministry of Construction shall approve results of public service pricing plan appraisal, consolidate and send them to the Ministry of Finance for maximum pricing;
The Vietnam Railway Authority shall promulgate a document on specific prices of public services for national railway infrastructure asset management and maintenance in accordance with the law on prices.
3. Railway work repair
a) For a work to be repaired costing VND 500 million or more, the national railway asset managing enterprise shall prepare a techno-economic report or set up a construction investment project and submit it to the Vietnam Railway Authority for appraisal and approval. The work repair shall comply with regulations of law on construction investment and relevant regulations of law;
b) For a work to be repaired costing less than VND 500 million, the national railway asset managing enterprise shall organize the preparation and approval of a technical plan - estimate and implement it
4. Repair and recovery from incidents or natural disasters with regard to railway works
a) Works for step 1 recovery from incidents or natural disasters
Procedures shall comply with regulations of the Minister of Construction on natural disaster recovery; incident response and rescue in the railway sector;
After the step 1 recovery from incidents or natural disasters, the national railway asset managing enterprise shall make a list of works and report it to the Vietnam Railway Authority for budget balancing for any update or addition to the management and maintenance plan or adjusted plan;
b) Works for step 2 recovery from incidents or natural disasters shall comply with clause 3 of this Article.
5. Upon the use of non-state budget capital for railway work management and maintenance, authorities and organizations in charge of railway work management and maintenance shall comply with regulations of law on management and use of public property and relevant laws.
Article 13. Management of quality of maintenance of railway works
1. Every national railway asset managing enterprise shall manage quality of maintenance of railway works as prescribed.
2. Management of materials, products, structural components and equipment used for railway work maintenance
a) For servicing of railway works, major materials and equipment undergo tests or suppliers are required to present full certificates of quality and origin before permitting the use thereof;
b) For repair of works: materials, products, structural components and equipment used in the works shall be managed in accordance with regulations on quality management, construction and maintenance of construction works.
3. Acceptance of railway work maintenance
a) For railway work servicing, the national railway asset managing enterprise shall conduct acceptance according to supervision and acceptance criteria and maintenance procedures;
b) For railway work repair; recovery from incidents or disasters affecting railway works, the national railway asset managing enterprise shall accept the construction task, accept the construction period or part of a work, accept a work item or construction work to be put into use according to the Government’s regulations on management of quality of construction and maintenance of construction works;
c) For other tasks under the approved railway work management and maintenance plan, the national railway asset managing enterprise shall organize the acceptance thereof in accordance with relevant laws.
4. The national railway asset managing enterprise shall organize the creation of a work servicing quality management system as the basis for management. The work servicing quality management system must follow the approved maintenance procedures.
Article 14. Periodic reporting during management of railway infrastructure and maintenance of railway works
1. Title of the report: Báo cáo định kỳ kết quả thực hiện công tác quản lý kết cấu hạ tầng, bảo trì công trình đường sắt (“Periodic report on management of railway infrastructure and maintenance of railway works”).
2. The report shall fully specify the following: tasks to be performed; quantities and funding approved by the Ministry of Transport or adjusted in the railway work management and maintenance plan; quality of performance of tasks, results of acceptance and payment; proposals and recommendations (if any).
3. Entity preparing the report: national railway asset managing enterprises.
4. Receiving authority: Vietnam Railway Authority, Ministry of Construction.
5. Report submission and receipt methods: the report is in physical form and submitted via the document exchange platform among the Ministry of Construction, Vietnam Railway Authority and national railway asset managing enterprises.
6. Submission deadline: before July 15 every year for a first-half year report; before January 15 of the next month for an annual report.
7. Reporting frequency: twice a year.
8. Data cutoff period: from January 01 to June 30 for a first-half year report; from January 01 to December 31 for an annual report.
9. Report form: using the form in the Appendix VI hereto.
Article 15. Responsibility for management of railway infrastructure and maintenance of railway works
1. The Vietnam Railway Authority shall:
a) Inspect the fulfillment of responsibilities and obligations of national railway asset managing enterprises for their management of railway infrastructure and maintenance of railway works as prescribed in this Circular;
b) Fulfill responsibilities and obligations of specialized construction authorities affiliated to the Ministry of Construction with regard to railway works serving repair under railway work management and maintenance plans.
2. According to their functions and tasks, Departments affiliated to the Ministry of Construction shall advise the Minister of Construction on state management of railway infrastructure and maintenance of railway works.
3. Every national railway asset managing enterprise shall:
a) Organize management of railway infrastructure and maintenance of railway works as prescribed;
b) Supervise the maintenance of railway works and take total responsibility for quantities and quality of maintenance of railway works, ensure smooth, orderly, safe, and accurate rail transport operations in accordance with law;
c) Organize periodic inspection and monitoring of the quality of railway works during their exploitation and use; repair minor damage to maintain stable technical status of railway works, and ensure safety of works and rail transport safety;
d) Assume responsibility for incidents or deterioration of works due to its failure to implement or incompletely implement contents of railway infrastructure management and railway work maintenance as prescribed.
Chapter IV
COSTS OF MANAGEMENT OF RAILWAY INFRASTRUCTURE AND MAINTENANCE OF RAILWAY WORKS
Article 16. Sources of funding for and details of costs of management of railway infrastructure and maintenance of railway works
1. Funding for management of state-invested railway infrastructure and maintenance of state-invested railway works shall be derived from the following sources:
a) State budget;
b) Other legitimate sources of funding as prescribed by law.
2. The management and use of funding for management of railway infrastructure and maintenance of railway works shall comply with applicable regulations.
3. Details of costs incurred in connection with the management of railway infrastructure and maintenance of railway works include:
a) Cost of formulation and verification of maintenance procedures and techno-economic norms for maintenance of railway works;
b) Costs of inspection, monitoring, quality inspection, safety assessment and repair of railway works, servicing of railway works and management and supervision of servicing of railway works;
c) Costs of compilation and updating of dossiers on management of railway infrastructure; costs of updating of data on maintenance of railway works;
d) Other necessary costs for maintenance of railway works in compliance with regulations of law on management of quality, construction and maintenance of construction works.
4. Costs of management of railway infrastructure and maintenance of railway works shall be determined as follows:
a) Regarding repair of railway works, the costs thereof shall vary according to each work or project in accordance with regulations of law on management of construction investment costs;
b) For servicing of railway works and step 1 recovery from incidents and natural disasters, the national railway asset managing enterprise shall organize the formulation of a public service pricing plan and cost estimate in accordance with the law on budget;
c) For other tasks, the costs thereof equal those in the estimates on the basis of contents and quantities of jobs performed in accordance with applicable regulations.
Chapter V
IMPLEMENTATION CLAUSE
1. This Circular comes into force from June 30, 2025 and supersedes the Circular No. 03/2021/TT-BGTVT dated February 08, 2021 of the Minister of Transport on management and maintenance of national railway infrastructure.
2. During the implementation of this Circular, if any of the legislative documents referred to in this Circular is amended, supplemented or superseded, the newest one shall apply.
Article 18. Transitional clause
1. Any work or task that has been approved and is being implemented until the effective date of this Circular but has not been completed shall continue to be implemented as prescribed in the Circular No. 03/2021/TT-BGTVT dated February 08, 2021 of the Minister of Transport.
2. Any work or task that has been approved prior to the effective date of this Circular but has not been implemented shall be implemented as prescribed in this Circular.
3. Every national railway asset managing enterprise shall update and supplement dossiers on management of railway infrastructure as prescribed in clause 1 Article 6 of this Circular to serve the management and maintenance of railway works as per regulations.
