Circular No. 20/2025/TT-BCT dated April 22, 2025 on prescribing import tariff-rate quota for unmanufactured tobacco in 2025

CIRCULAR

PRESCRIBING IMPORT TARIFF-RATE QUOTA FOR UNMANUFACTURED TOBACCO IN 2025

Pursuant to the Law on Foreign Trade Management dated June 12, 2017;

Pursuant to the Law on Prevention and Control of Harmful Effects of Tobacco dated June 18, 2012;

Pursuant to the Government's Decree No. 40/2025/ND-CP dated February 26, 2025 defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade of Vietnam;

Pursuant to the Government’s Decree No. 69/2018/ND-CP dated May 15, 2018 elaborating some articles of the Law on Foreign Trade Management;

Pursuant to the Government’s Decree No. 67/2013/ND-CP dated June 27, 2013 elaborating the Law on Prevention and Control of Tobacco Harms with respect to tobacco trading;

Pursuant to the Government’s Decree No. 106/2017/ND-CP dated September 14, 2017 providing amendments to the Government’s Decree No. 67/2013/ND-CP dated June 27, 2013 elaborating the Law on Tobacco Harm Prevention and Control with respect to tobacco trading;

Pursuant to the Government’s Decree No. 08/2018/ND-CP dated January 15, 2018 providing amendments to Decrees on investment and business requirements under state management of the Ministry of Industry and Trade of Vietnam;

Pursuant to the Government’s Decree No. 17/2020/ND-CP dated February 05, 2020 providing amendments to Decrees on investment and business requirements under state management of the Ministry of Industry and Trade of Vietnam;

At the request of the Director of the Agency of Foreign Trade;

The Minister of Industry and Trade of Vietnam promulgates a Circular prescribing import tariff-rate quota for unmanufactured tobacco in 2025.

Article 1. Import tariff-rate quota for unmanufactured tobacco in 2025

The import tariff-rate quota for unmanufactured tobacco (HS code: 2401) in 2025 is 75.427 tonnes.

Article 2. Entities eligible for import tariff-rate quota for unmanufactured tobacco in 2025

The import tariff-rate quota for unmanufactured tobacco in 2025 shall be allocated to traders that hold valid license for manufacturing of tobacco products or license for processing of unmanufactured tobacco issued by the Ministry of Industry and Trade of Vietnam and wish to import unmanufactured tobacco under the import quota to serve their manufacturing, or processing of unmanufactured tobacco to serve manufacturing, of cigarettes for domestic consumption.

Article 3. Methods for allocation of import tariff-rate quota for unmanufactured tobacco in 2025

The Ministry of Industry and Trade of Vietnam shall consider allocating the import tariff-rate quota for unmanufactured tobacco in 2025 to the eligible entities prescribed in Article 2 of this Article by means of import licenses issued in accordance with the provisions of the Government’s Decree No. 69/2018/ND-CP dated May 15, 2018 and the Circular No. 12/2018/TT-BCT dated June 15, 2018 of the Minister of Industry and Trade of Vietnam.

Article 4. Time for allocation of import tariff-rate quota for unmanufactured tobacco in 2025

The allocation of import tariff-rate quota for unmanufactured tobacco in 2025 shall start from the date of entry into force of this Circular.

Article 5. Effect

This Circular comes into force from the day on which it is signed for promulgation to December 31, 2025 inclusively./.
