CIRCULAR

AMENDING ARTICLE 3 OF CIRCULAR 09/2025/TT-BCT DATED FEBRUARY 01, 2025, OF THE MINISTER OF INDUSTRY AND TRADE ON DOCUMENTATION, PROCEDURES FOR DETERMINING, APPROVING PRICE BRACKET FOR ELECTRICITY GENERATION; DOCUMENTATION, PROCEDURES FOR DEVELOPING, APPROVING PRICE BRACKET FOR IMPORTED ELECTRICITY

Pursuant to Law on Electricity dated November 30, 2024;

Pursuant to Decree No. 40/2025/ND-CP dated February 26, 2025, of the Government on the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

At the request of Director General of Electricity Authority of Vietnam.

The Minister of Industry and Trade issues a Circular amending Article 3 of Circular No. 09/2025/TT-BCT dated February 1, 2025 of the Minister of Industry and Trade on the documentation, procedures, methods for determining and approving the price bracket for electricity generation; documentation, procedures for developing and approving the price bracket for imported electricity.

Article 1. Amendments to Clauses 7 and 8 of Article 3 of Circular No. 09/2025/TT-BCT dated February 1, 2025 of the Minister of Industry and Trade on the documentation, procedures, methods for determining and approving the price bracket for electricity generation; documentation, procedures for developing and approving the price bracket for imported electricity:

“7. The electricity generation price bracket for wind power plants built by regions and sea areas based on the results of wind power resource surveys in accordance with the law. To be specific:

a) The electricity generation price bracket for inland and inshore wind power plants built by 03 (three) regions: the North, the Central and the South.

b) The determination of areas to build the electricity generation price bracket for offshore wind power plants is based on:

b1) National marine spatial planning;

b2) National electricity development planning.

In the 2025–2035 period, the electricity generation price bracket for offshore wind power plants shall be developed by 03 (three) sea areas: the North, the South Central, and the South.

8. The determination of areas for developing the electricity generation price bracket for solar power plants and inland and inshore wind power plants is based on:

a) Division of socio-economic regions in the National Master Plan;

b) National electricity development planning;

c) Guidelines and decisions of competent authority on arrangement, merger, and acquisition of provincial-level administrative units.”

Article 2. Implementation clauses

1. This Circular comes into force from May 13, 2025.

2. Shall any problems arise during the implementation process, promptly report to the Ministry of Industry and Trade for appropriate amendments./.
