CIRCULAR
AMENDMENTS TO CERTAIN ARTICLES OF THE CIRCULAR NO. 02/2018/TT-BCT DATED FEBRUARY 27, 2018 OF THE MINISTER OF INDUSTRY AND TRADE ELABORATING THE LIST OF GOODS TRADED AND EXCHANGED BY BORDER RESIDENTS
Pursuant to the Law on Foreign Trade Management dated June 12, 2017;
Pursuant to the Government’s Decree No. 40/2025/ND-CP dated February 26, 2025 defining functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Government’s Decree No. 14/2018/ND-CP dated January 23, 2018 elaborating upon border trade activities;
Pursuant to the Government’s Decree No. 122/2024/ND-CP dated October 04, 2024 on amendments to some Articles of the Decree No. 14/2018/ND-CP ;
At the request of the Director General of the Agency of Foreign Trade,
The Minister of Industry and Trade hereby promulgates a Circular on amendments to certain Articles of the Circular No. 02/2018/TT-BCT dated February 27, 2018 of the Minister of Industry and Trade elaborating the List of goods traded and exchanged by border residents.
Article 1. Amendments to certain Articles of the Circular No. 02/2018/TT-BCT dated February 27, 2018 of the Minister of Industry and Trade elaborating the List of goods traded and exchanged by border residents
1. Clause 1 of Article 2 is amended as follows:
“1. Border residents trading and exchanging goods across border specified in clause 1 Article 1 of the Decree No. 122/2024/ND-CP”.
2. Article 3 is amended as follows:
“Article 3. Goods traded and exchanged across border by border residents
1. Goods exported in the form of trading and exchange by border residents shall comply with applicable laws.
2. Goods imported in the form of trading and exchange by border residents are specified in the Appendix I to this Circular.
3. Goods other than those on the List specified in clause 2 of this Article shall not be imported in the form of trading and exchange by border residents.
4. In case it is needed to ensure food safety and prevent cross-border diseases, the Ministry of Industry and Trade shall, after discussing with related ministries and central authorities, decide to suspend the import of several goods on the List of goods traded and exchanged by border residents promulgated under clause 2 of this Article in each locality for a specific period of time”.
Article 2. Replacing the Appendix I - List of goods imported in the form of trading and exchange by border residents under the Circular No. 02/2018/TT-BCT
The Appendix I - List of goods imported in the form of trading and exchange by border residents under the Circular No. 02/2018/TT-BCT is replaced with the Appendix I to this Circular.
Article 3. Implementation clause
This Circular comes into force from July 21, 2025./.
